1. Agreement to These Terms

Effective Date: 26 May 2025

By accessing or using any part of Trailbound—including its websites, Discord bots, APIs, mobile/desktop clients, games, NFTs, and related services operated by Tatsu Works Pte Ltd (UEN 201918745M) (“Tatsu”, “we”, “our” or “us”)—you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you disagree with any provision, do not use the Services.

2. Use of Websites, Social Channels, Games, and Services

Term	Meaning
Trailbound	The ecosystem comprising all products, sites, and digital assets operated by Tatsu.
Services	Any software, game, bot, API, website, NFT, Virtual Item, or feature within Trailbound.
Games	Tatsu.GG, Trailbound, Lumina Hunt, The Uncharted Dream, and any future titles.
NFTs / Digital Assets	Blockchain-based tokens issued by Tatsu—currently Meekolony Passes andAethereal Parcels—that unlock or enhance functionality in the Services.
Virtual Items	In-game currencies or collectibles (including NFTs) usable inside the Services.
UGC	User-generated content (text, images, audio, video, code, feedback) you submit.

3. Eligibility

3.1.Age: You must be at least 13 years old. Users aged 13–17 require a parent or legal guardian to review and agree to these Terms; we may request proof.

3.2.Legal Capacity: You confirm you are not in an embargoed jurisdiction and not on any sanctions list (see §14 Export Controls).

4. Account Registration & Security

4.1.Authentication: Most Services authenticate through your Discord account; some may require a Tatsu, email, or wallet log-in. You are responsible for securing all credentials.

4.2.Accurate Information: Provide true, complete, and current data. We may suspend or terminate accounts containing false information.

4.3.Security Incidents: Report unauthorised access immediately to [email protected]. We may require MFA or re-verification.

5. Licence Grant & Restrictions

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Services for non-commercial entertainment. You may not:

5.1.Reverse-engineer, decompile, or derive source code.

5.2.Use cheats, bots, exploits, or unauthorised third-party software.

5.3.Sell, lease, or sublicense the Services, Virtual Items, or NFTs except through features we provide.

5.4.Engage in harassment, hate speech, doxxing, illegal content, or real-money trading of accounts/items.

5.5.Use the Services for commercial promotion without our written consent.

6. Virtual Items, NFTs, Purchases & Refunds

6.1.Ownership: Virtual Items and NFTs are licensed, not sold; they confer limited rights within the Services and have no intrinsic real-world monetary value.

6.2.Blockchain Assets: NFTs exist on public blockchains. You bear sole responsibility for wallet security, gas fees, and any tax or regulatory implications. NFTs are not investment products; values may fluctuate or reach zero.

6.3.Purchases: All sales are final except where mandatory law grants a refund right (e.g., EU 14-day withdrawal). EU/UK users acknowledge that digital delivery starts immediately and waive the statutory withdrawal right.

6.4.Chargebacks: Unauthorised chargebacks may result in suspension and debt collection.

7. User-Generated Content (UGC)

7.1.Licence to Tatsu: You grant Tatsu a perpetual, worldwide, royalty-free licence to use, reproduce, modify, adapt, and display your UGC in connection with the Services.

7.2.Notice-and-Takedown: Alleged copyright infringements should be reported via [email protected] with the information required under 17 U.S.C. §512. Counter-notices follow the same statute.

7.3.Your Warranty: You warrant you have the rights to upload the UGC and that it complies with law and third-party rights.

8. Community Guidelines

Our Community Guidelines (posted in the official Discord server) and Discord’s Terms of Service are incorporated by reference. Violations may result in content removal, temporary suspension, or permanent bans.

9. Updates, Patches & Availability

We may modify, suspend, or discontinue any part of the Services at any time. Updates may affect gameplay, NFTs, or Virtual Items. Tatsu is not liable for loss of progress, features, or items caused by updates or downtime, except where required by law.

10. Third-Party Services

The Services integrate with Discord, payment processors, wallet providers, and cloud hosts. Your use of those services is governed by their separate terms and privacy policies. Tatsu is not responsible for their acts or omissions.

11. Export Controls & Sanctions Compliance

You agree not to use the Services if you (a) are located in a country subject to embargoes or (b) appear on any sanctions list (e.g., OFAC SDN). You will not export or transfer the Services or NFTs in violation of applicable export laws.

12. Force Majeure

Tatsu is not liable for failure to perform due to causes beyond reasonable control (e.g., natural disasters, war, labour disputes, Internet outages, acts of government, or cloud-service failure).

13. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, except where prohibited by law.

14. Limitation of Liability

To the maximum extent permitted, Tatsu and its affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages. Total cumulative liability will not exceed (a) S$100 or (b) the amounts you paid in the preceding 12 months, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Tatsu, its affiliates, and employees from claims arising out of (a) your breach of these Terms, (b) your UGC, or (c) your violation of law or third-party rights.

16. Feedback Licence

If you send ideas or suggestions, you grant Tatsu a non-exclusive, royalty-free, perpetual licence to use them without restriction or compensation.

17. Dispute Resolution & Arbitration

17.1.Informal Negotiation: Email [email protected] and allow 30 days to resolve disputes informally.

17.2.Notice-and-Takedown: Unresolved disputes (except qualifying small-claims cases) shall be finally settled by binding arbitration administered by the Singapore International Arbitration Centre (SIAC). Seat: Singapore. Language: English.

17.3.Your Warranty: No class, collective, or representative actions are permitted.

18. Governing Law & Jurisdiction

These Terms are governed by Singapore law. Where arbitration is prohibited, you consent to exclusive jurisdiction of Singapore courts.

19. Changes to These Terms

We may update these Terms. Material changes will be announced 14 days in advance via Discord and the product sites. Continuing to use the Services after the effective date constitutes acceptance.

20. Product-Specific Terms (Annexes)

Future titles may introduce additional annexes; the master Terms will direct you to them.

21. Dispute Resolution & Arbitration

21.1.Severability: If any provision is invalid, the remainder stays in effect.

21.2.No Waiver: Failure to enforce a provision is not a waiver.

21.3.Assignment: Tatsu may assign these Terms; you may not without our consent.

21.4.Entire Agreement: These Terms, the Privacy Policy, and annexes constitute the entire agreement between you and Tatsu.
